End User License Agreement (“Agreement”)

This End User License Agreement (“Agreement”) is a legal contract between you (“User,” “you”) and [Holistic Perspective] (“Company,” “we,” “our,” or “us”) regarding your use of the [Holistic Perspective] desktop software application (“Application”).

By opening, or using the Application, you agree to the terms of this Agreement. If you do not agree, please do not use the Application.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on your desktop computer for personal, educational, or internal clinical purposes in accordance with this Agreement.

2. Nature of the Application

The Application provides tools for symptom tracking, homeopathic assessment prompts, and educational resources.

The Application does not diagnose, treat, cure, or prevent disease, nor is it a substitute for professional medical advice, diagnosis, or treatment. Clinical decisions remain solely the responsibility of the practitioner or user.

3. Regulatory Compliance Notice

Our tools are designed to support global users in accordance with major regulatory frameworks, including FDA, GDPR, and HIPAA principles. However:

• The Application is not a medical device and is not intended to replace medical judgment.
• The Application provides informational content only and should not be used as a sole basis for medical decision-making.
• Users are responsible for ensuring compliance with local laws, licensing obligations, and clinical standards within their region.

4. Restrictions

You agree not to:

• Modify, alter, translate, or create derivative works of the Application.
• Reverse engineer, decompile, or attempt to extract source code except where permitted by applicable law.
• Sell, sublicense, rent, lease, or distribute the Application or access to it.
• Use the Application for any unlawful, harmful, or unauthorized purpose, including automated data scraping or misuse of health-related information.

5. Data Privacy & Security

We are committed to protecting user data through ethical and legally aligned practices.

• The Application may store data locally on your device.
• If cloud features or practitioner communication tools are used, data may be transmitted according to our Privacy Policy.
• Users are responsible for securing their own device and access credentials.

6. Updates & Improvements

We may release updates, patches, or enhancements from time to time. Updates are governed by this Agreement unless accompanied by new terms.

7. Disclaimers

The Application is provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• warranties of accuracy, merchantability, non-infringement, or fitness for a particular purpose;
• warranties regarding uninterrupted or error-free operation;
• warranties that the Application will meet specific clinical, therapeutic, or health-related outcomes.

8. Limitation of Liability

To the maximum extent permitted by law, [Holistic Perspective] is not liable for:

• indirect, incidental, special, exemplary, or consequential damages;
• loss of profits, data, or business opportunities;
• any decision made or action taken based on information provided by the Application.

Your sole remedy for dissatisfaction with the Application is to discontinue its use.

9. Termination

This Agreement remains effective until terminated.

We may terminate your license if you violate any term of this Agreement. Upon termination, you must stop using the Application and delete all copies from your devices.

10. Governing Law

This Agreement will be governed by the laws of [Poland], without regard to its conflict-of-law principles.
